Appeals court temporarily allows Trump to keep National Guard in LA
Press Secretary Says Executive Order to Deploy National Guard is Needed to Help Restore Law and Order
In a ruling on Wednesday, a US appeals court temporarily allowed President Trump to maintain deployment of the National Guard in Los Angeles, upholding the presidents executive order and bypassing the cities mayor.
The decision, made by the US Court of Appeals for the Ninth Circuit, allows the guard to remain in the city until at least 14 June. The two-to-one ruling granted a request by the US Department of Justice (DoJ) to stay a previous ruling made by a California judge.
The DoJ had asked for the stay, claiming that Los Angeles Mayor Eric Garcetti had not shown that the governments action had caused him irreparable injury.
The panel said the city had not shown that the governments actions had caused it injury that would be difficult to fix.
The White House has maintained that the use of the National Guard in Democratic-run cities is necessary to stem the tide of anti-police-violence protests and vandalism that have taken place during this unprecedented era of civil unrest.
We are thrilled that the Ninth Circuit unanimously agreed to stay the improper injunction imposed by the district court, said Assistant Attorney General Eric Dreiband in a statement. We will continue to fight for the presidents executive orders, which are designed to protect law enforcement and restore safety to our communities.
